BID PROTESTS: DESCRIPTION

A substantial area of McKenna Long & Aldridge LLP's government contracts litigation work concerns protests over the award of government contracts at both the federal and state levels. We have successfully handled numerous protests on behalf of clients challenging contract awards and those seeking to retain awarded contracts. Our bid protest practitioners represent our clients at the federal level before the Government Accountability Office and U.S. Court of Federal Claims, and we represent our clients before the procurement agencies of states throughout the country. Our practitioners are experienced in the critical areas affecting our clients' ability to compete for and win contract awards:

  • Past performance determinations
  • Best value determinations and cost-technical tradeoffs
  • Compliance with evaluation criteria
  • Proposal responsiveness issues

Our protest lawyers regularly handle complex protests of federal procurements. Those protests involve the full spectrum of federal procurements for goods and services including large-scale weapons systems, long distance telephone systems; IT and software procurements; commercial item acquisitions; construction and public works projects; health care systems, and professional support services.
