PROFILE

Jimmy Tabb is a litigation partner who concentrates his practice in representing clients facing potential liability in securities claims (civil and criminal), wage and hour class actions, and environmental actions. Jimmy also represents clients in related class actions to recover insurance benefits.

Jimmy is active in the pro bono efforts, having assisted an Ethiopian refugee obtain political asylum, and a teenage Honduran refugee obtain Special Immigrant Juvenile status

Jimmy received his J.D., magna cum laude, from the University of Georgia School of Law in 1997, where he was a member of the Law Review and the Mock Trial Team.  He was elected to the Order of the Coif, and was admitted to the State Bar of Georgia in 1997 (inactive) and the State Bar of California in 2000 (active).  He clerked for the Honorable William T. Moore, Jr., in the United States District Court for the Southern District of Georgia before joining the Atlanta office of MLA legacy, Long Aldridge & Norman, in 1998.  He then moved to California  and joined MLA in January 2005 following the merger with McKenna Cuneo.

His successes include:

  • Acted as second chair trial counsel for corporate defendant in multi-million dollar breach of contract, tort, and punitive damages action in which the plaintiffs dismissed their tort and punitive damages claims against the Firm's client during trial, and in which the Court found for the Firm's client on all contract interpretation issues, thereby reducing the plaintiffs' contract damages claim by approximately $3.3 million.
  • Obtained dismissal, and appellate affirmance of same, on behalf of corporate defendant in action challenging sales tax charges to clients’ customers pursuant to California regulations 
  • Obtained summary judgment on behalf of corporate policyholder in $75+ million indemnity case arising out of construction dispute in Australia. Secured carrier-funded defenses on behalf of corporate policyholders in multi-million dollar environmental and construction disputes.
  • Negotiated settlement on behalf of corporate policyholder in multi-million dollar builder's risk policy claim.
  • Participated in negotiations that resolved decades-old CERCLA disputes arising out of the contaminated Stringfellow Hazardous Waste Site. Participation included assisting the State of California in its insurance coverage litigation.
  • Obtained air emission variances from San Diego County Air Pollution Control District Hearing Board during California's energy crisis.
