Mark Kaufman is a highly experienced commercial litigator and senior member of the Restructurings, Bankruptcy and Creditors' Rights Team, concentrating on bankruptcy matters, troubled asset dispositions, business dispute litigation, and out-of-court business reorganizations. He has a business litigation background and now principally focuses on bankruptcy reorganization, financial disputes, stressed asset dispositions, and Creditors' Rights matters. He has appeared as lead trial counsel in business and bankruptcy cases in federal courts throughout the United States, and has argued cases on appeal before the Ninth, Fifth, and Eleventh Circuits.
Concentrating in the representations of secured creditors, lenders, investors, and committees, Mark has also represented debtors in significant Chapter 11 cases, including as lead counsel of one of the nation's most significant utility bankruptcies.
He has served as President of the Bankruptcy Section of the Atlanta Bar Association and as a Director and currently serves as President of the Southeastern Bankruptcy Law Institute. He also chaired Georgia's Bankruptcy Bench and Bar Conference.
Mark has participated in Leadership Georgia, served as a member of the Georgia Citizens Conference on the Judiciary and chaired several committees of the Atlanta Bar Association, including a task force to evaluate the performance of the Atlanta Municipal Court.
Mark has received several recognitions, including being named to the 2006 and 2007 editions of Best Lawyers in America, where he is featured for bankruptcy and creditors' rights law. Mark was also recently selected for inclusion in the first edition (2006) of Who's Who Legal USA-Insolvency & Restructuring, which features a total of less than 300 lawyers throughout the United States who practice in the business bankruptcy and creditors' rights field. Chambers USA has included him (from 2003-current) in their Client's Guide to America's Leading Lawyers for Business, recognizing Mark's achievements in its Bankruptcy and Creditors' Rights section. Mark has also been named as a Georgia Super Lawyer by Atlanta Magazine in 2003-2008, and as one of Georgia Trend Magazine's Legal Elite in 2003-2006.
Mark has frequently spoken nationally and locally to bar and key financial groups on bankruptcy and restructuring topics.
