PROFILE

Donna Lee Yesner practices in the area of public health care and government contracts with a focus on pharmaceutical and medical device manufacturers’ public sector business.

Ms. Yesner specializes in federal health care acquisition, particularly VA  and DoD procurement, Medicaid and Medicare compliance, the 340B Drug Discount Program, and health care fraud.  She is former Chair of the ABA Public Contracts Section Health Care Contracting Committee and is counsel to the Coalition for Government Procurement Health Care Committee.  She recently won an important case in the U.S. Court of Appeals on behalf of the Coalition which saved the pharmaceutical industry hundreds of millions of dollars in unlawful rebate claims.

Ms. Yesner is also experienced in all aspects of federal procurement, and has particular experience in the areas of suspension and debarment , national security issues, and intellectual property rights under government contracts. In addition, Ms. Yesner has litigation and ADR experience before the Boards of Contract Appeals, the United States District Courts and Courts of Appeals, and the United States Court of Federal Claims.

Ms. Yesner speaks frequently to industry groups on pharmaceutical contracting and compliance.  She is also the co-author of "The Federal Healthcare Contracts Handbook," NCMA (1999) and "Recovery of Legal Costs," Briefing Papers, No. 93-12 (November 1993), Federal Publications, Inc.
