McKenna & Cuneo, L.L.P., and Technology Sciences Group Inc. will conduct a seminar on the Toxic Substances Control Act ("TSCA") on May 3-4 in Washington, D.C.

TSCA affects all companies that do business in the United States. It is a broad-ranging environmental statute that affects not only chemical manufacturers, but companies that use, process, distribute, import, and export chemical products as well. This course is intended for regulatory personnel, attorneys and corporate managers, as each presentation will emphasize practical compliance advice and management tips, as well as basic requirements of the law.

TSCA is administered by the United States Environmental Protection Agency. The Agency maintains a sophisticated enforcement program and prosecutes TSCA violations in all of its regional offices. Civil penalties of up to $27,500 per day may be imposed for many violations and million-dollar penalties are not unusual; six-figure penalties have become the norm. EPA assessed over $26.5 million in TSCA administrative penalties in fiscal year 1997 alone.

This two-day seminar addresses TSCA requirements in detail, with emphasis on the steps necessary to develop and maintain an effective TSCA compliance program.

The course includes presentations on requirements for the manufacture, importation, distribution and use of chemicals; the TSCA Inventory; premanufacture notification; test rules, consent orders and significant new use rules. The course also addresses enforcement and self-protection issues; auditing; international TSCA counterparts; and developing and maintaining a compliance program.
