PROPOSITION 65 SEMINAR

"Understanding the California Law that Affects Every Business in America"
McKenna & Cuneo, L.L.P., and Technology Services Group Inc. will conduct a seminar on California's Proposition 65 on May 5-6 in Washington, D.C. The seminar will explain why all companies that manufacture, distribute, or sell products in California, as well as companies with facilities in California, fall under the requirements of Proposition 65. The seminar presentations address Proposition 65 from three perspectives: statutory, regulatory, and scientific.
Proposition 65 requires warnings for exposures to chemicals "known to the State" to cause cancer or reproductive harm, whether from plant emissions, or from products that contain them. The law also prohibits the discharge of such chemicals into drinking water. The law is enforced not only by the State, city or county prosecutors, but also by private citizen "bounty hunters," and has spawned six-figure and million-dollar settlements.
Failure-to-warn cases have been brought against manufacturers, distributors and retailers of products ranging from children's toys to diesel engines; pharmaceuticals to firearms; industrial chemicals to dental fillings; cigars and cigarettes to plumbing fixtures; food packaging to light bulbs. Drinking water discharge cases have been brought against manufacturers, distributors and users of chemical products.
This seminar will be co-chaired by Stanley W. Landfair, a partner from McKenna & Cuneo's West Coast Environmental practice, and by Dr. Arthur L. Lawyer of Technology Sciences Group, Inc. Presentations will be made by attorneys from McKenna & Cuneo and scientific consultants from Technology Sciences Group.
The statutory presentations will address listing and warning requirements, the discharge prohibition and "bounty-hunter" enforcement. The regulatory presentations will discuss "safe harbor" warning requirements. The scientific presentations will deal with the criteria for listing chemicals as carcinogens and reproductive toxins, and establishing "No Significant Risk Levels." The seminar also will provide information on conducting effective exposure and risk assessments; special rules for out-of-state manufacturers; special rules for foods, drugs, cosmetics and medical devices; how the law is applied to consumer goods and manufacturers and distributors of workplace (industrial) products; drinking water discharge claims; and defending a Proposition 65 lawsuit.
